Boulder Police said no charges will be filed in the deadly crash.

BOULDER, Colo. — A man is dead after a collision with a cyclist in Boulder on Sunday.

The Boulder Police Department said at about 1:15 p.m. Sunday, officers were called to the intersection of the Creek Path and Foothills Bikeway for a report of a collision between a cyclist and a runner.

Police said it appears the cyclist and the runner saw each other and tried to avoid each other, but they still collided and hit their heads on the cement as they fell.

The 34-year-old man on the bicycle, who was wearing a helmet, was not hurt. The 73-year-old runner was taken to the hospital in critical condition and died on Tuesday. The Boulder County Coroner’s Office has identified him as Richard E. Poley of Boulder.

Police do not suspect that alcohol or drug impairment were involved in the crash, which they said appears to have been unintentional. After consulting the Boulder County District Attorney’s Office, no charges will be filed.
