John Thoren fatally shot the woman in the early morning hours of Oct. 28, 2022, while his truck was parked behind an Aurora business.
AURORA, Colorado — An Arapahoe County jury convicted a man of second-degree murder for fatally shooting a woman who had thrown rocks at his semi-truck.
The jury returned its verdict against 44-year-old John David Thoren III on Friday following a four-day trial.
Thoren was sleeping in his semi-truck behind the Boot Barn on South Parker Road near Arapahoe Road on Oct. 28, 2022 when he said he was woken up by a woman throwing rocks at the driver’s side of the truck. He said he told the woman to stop and then showed a gun and threatened to shoot her if she didn’t stop.
The woman, identified as Rachel Holmes, 46, was shot and pronounced deceased on-scene. Thoren called 911 to report the shooting, but he did not render aid.
When questioned by investigators, he said he was scared for his safety and admitted to shooting the victim. Officers found large landscaping rocks on the ground near the truck but reported minimal damage to the vehicle.
“Instead of driving to a safe location or calling 911 to report someone throwing rocks at his truck, the defendant decided to take matters into his own hands by confronting the woman with a gun and pulling the trigger,” Senior Deputy DA Michael Mauro said. “Based on the facts of this case, deadly use of force was not justified.”
Thoren will be back in court for sentencing on July 22.
