Man arrested in shooting of Adam Fresquez at Tesla charger

Jeremy Smith was arrested Tuesday in connection with the shooting of Adam Fresquez at a Tesla charging station in May.

EDGEWATER, Colo. — A man has been arrested in connection with a May shooting death at a Tesla charging station, the Edgewater Police Department said.

Jeremy Smith, 39, was arrested Tuesday in connection with the shooting of Adam Fresquez, 33. Smith is being held on charges of second-degree murder and manslaughter, police said.

Fresquez had a wife and two children. His mother, Lena Mendez, described him as a fun, loving and caring family man. 


The shooting happened around 9:30 a.m. May 3 near the Tesla supercharger station at the Edgewater Public Market on 20th Avenue.

According to police, video evidence showed Fresquez and Smith arrived at the supercharger station within seconds of each other. Once parked, Fresquez was seen walking toward Smith’s Tesla, police said in a news release. Less than a minute later, they said, Fresquez is seen stumbling. Smith is then seen pulling out of the parking space and driving east. 

Within minutes, police said, Smith called 911 and reported that he had used Mace and shot someone at the charging station after that person “pulled a gun” on him. He was detained after the shooting and later released.

“The months-long investigation revealed that Smith and Fresquez, both driving Tesla vehicles, engaged in road rage that led to a confrontation,” police said in the release. “Evidence indicates that Fresquez was Maced and shot twice in the back. The evidence further indicates that both Fresquez and Smith were armed, after West Metro Fire Department personnel located a firearm inside Fresquez’s clothes, near his groin area.”

Police presented their investigation to the district attorney’s office on Sept. 19, police said. 


“In the following months, the investigation continued, and additional items of evidence were collected and submitted for forensic testing,” police said. They said those test results came in on Dec. 6. 

Smith was arrested Tuesday. His first court appearance is set for Wednesday.
