A search warrant affidavit reveals what a construction manager told police after he fatally shot two people who may have been trying to burglarize a site.
DENVER — A construction manager says in new court documents that a man and a woman wearing construction vests attacked him with mace before he fatally shot them at a construction site.
The shooting happened Feb. 24 at a former TJ Maxx that is being converted into a supermarket near Wadsworth Boulevard and Belleview Avenue in southwest Denver.
A search warrant affidavit filed in Denver District Court on Wednesday describes the scene as police arrived and encountered the construction manager who “appeared to be experiencing the effects of being sprayed with a chemical agent.”
9NEWS is not naming the manager because he has not been charged.
The manager told police he was checking up on the site because of recent issues with copper thefts and that he took his .40 caliber gun with him “because he was unsure of what/who he may encounter upon entering.”
The manager said a man and a woman “who were robbing him came at him with duct tape, the male party was wearing a mask, and they both had construction vests on.”
The manager fired several shots, hitting Timothy Walker, 40, who died on the scene. Patience McFall, 37, was shot once. McFall was ultimately pronounced dead at the hospital.
Walker and McFall had multiple arrests on their criminal records for theft and narcotics.
Last week, a spokesperson for Denver’s District Attorney indicated charges would not be filed against the construction manager because “there is a significant claim of self-defense on the part of the shooter.”
9NEWS reached out to the construction manager several times for comment, but he did not reply.
