Public schools of choice was put into state law in 1994. This year, Amendment 80 asked voters to put school choice in the state’s constitution.

COLORADO, USA — Late Tuesday night, the vote on Amendment 80 was too close to call.

The amendment is a measure enshrining the right to school choice into the state constitution. Under the amendment, school choice would include neighborhood, charter, private, and home schools, open enrollment options and future innovations in education. It was one of 14 statewide ballot issues Colorado voters had to decide on this year.

This is a constitutional amendment, so it will need 55% of the vote to pass.

What does Amendment 80 do?

According to the Amendment 80 section in the Colorado Blue Book:

“Amendment 80 creates a constitutional right to school choice and equal opportunity for K-12 children. The measure also creates the right for parents to direct the education of their children. Neighborhood and charter schools, private schools, home schools, open enrollment options, and future innovations in education are included in the new constitutional definition of school choice.”

A YES vote on Amendment 80 creates a constitutionally protected right to school choice for K-12 children and their parents. It specifies that school choice includes public, private, homeschool and any future innovations in education.

A NO vote on Amendment 80 maintains the current system of school choice in state law. 

Amendment 80 fiscal impact

In the Colorado Blue Book, it states Amendment 80 has no immediate impact on education-related spending by the state or school districts but may increase their spending on legal expenses and planning costs. The measure may change the allocation of state or local funding for education
